Westlock County has established an Industrial Park located one – half mile south of the Town of Westlock ’s corporate boundaries.

All properties can be subdivided/developed to suite the potential owner’s needs and intentions.

The following is an excerpt from Westlock County ’s Land Use By-law outlying the various uses and regulation of the Industrial Park.

6.8     INDUSTRIAL (M) DISTRICT

The general purpose of the District is to provide for specific areas where industrial development may take place within the County.

6.8.1        Permitted Uses

(a)        Light Industrial Uses (See Section 7.24 below)

(b)        Public and quasi-public uses

(c)        Other uses which, in the opinion of the Development Authority, are similar to the above mentioned permitted uses

(d)        Accessory buildings and uses incidental to permitted uses

6.8.2        Discretionary Uses

(a)        Commercial uses (See Section 7.23 below)

(b)        Other industrial uses

(c)        Other uses which, in the opinion of the Development Authority, are similar to the above mentioned discretionary uses

(c)        Accessory buildings and uses incidental to discretionary uses

 

7.23  COMMERCIAL DEVELOPMENT

 

7.23.1  Commercial development may be permitted within the hamlets.

 

7.23.2  No development permit shall be issued for proposed commercial uses in the Agricultural (A1) District unless it:

 

(a)        is located on lower capability agricultural land; or

(b)        directly serves the agricultural community; or

(c)        is adjacent to a primary or secondary highway; or, notwithstanding the above

i)          is operated as a secondary use to a farming operation; or

ii)         has site specific requirements that cannot be met elsewhere in the Agricultural (A2) District.

 

7.23.3  No development permit shall be issued for proposed commercial uses in the Agricultural (A2) District unless it:

(a)        is located on lower capability agricultural land within the A2 District; or

(b)        is located anywhere in the Agricultural (A2) District if the proposal has site specific requirements that cannot be met in subsection 7.23.3(a).

 

7.23.4  All site regulations and requirements shall be based upon the type of development proposed, and shall be at the discretion of the development authority.

 

7.23.5  Commercial development shall be subject to a development agreement between the developer and the Municipal District.

 

7.23.6    No development permit shall be issued for proposed commercial uses in the Natural Use District or in the Country Residential District.

All properties must be sold at fair market value.

The following is the existing County policy applicable to the tax forfeiture process:

 

TITLE:    SALE OF PROPERTIES

PURPOSE: To provide guidelines for the sale of County-owned or tax recovery properties.

POLICY STATEMENT:

Westlock County may market, through a licensed real estate office or other avenues, properties to which title is vested in their name or properties held by the County through the Municipal Government Act or any other Acts.

Upon receiving a written offer to purchase properties, Administration will obtain the fair market value for the property through one or more of:

·        the County's appointed Assessor

·        an external market evaluation by an independent property appraisal firm

·        a pre-determined value approved by the County by way of a Council resolution

·        valuation by a licensed real estate agent

The County, by way of Council resolution, may offer properties for sale through a Request for Proposal or general tender process, advertising the properties in the local newspaper.

All offers, excepting those issued in response to a real estate listing, must be accompanied by a deposit representing 10% of the offer.

County Council will have final approval on all offers.  Cash payment is due in full upon acceptance of an offer, and must be received prior to the transfer of the title to the purchaser.

All sales, excepting sales of properties subdivided by the County, will be made with the express understanding that the County will not re-establish the property lines either prior to or after the transfer of title.

All properties are sold "as is" with existing conditions unless otherwise specifically stated in writing in the sales agreement.
